1. Acceptance of Terms
When you create an account, purchase a subscription, or use the CloudDeck service in any way, you confirm that you have read, understand, and agree to these Terms of Service (“Terms”). If you do not accept these Terms in full, you must not use the CloudDeck service.
2. Service Description
CloudDeck offers a premium cloud gaming service that provides full access to a virtual cloud gaming console accessible over the internet (“Service”). This allows you to stream and play games without needing physical gaming hardware, aside from compatible input devices and a capable device for accessing CloudDeck.
3. Account Registration
An account must be registered to access CloudDeck services. You are responsible for providing accurate and complete information at registration and for keeping this information up to date. You are also responsible for maintaining the security of your account and for all activities that occur under your account. CloudDeck is not liable for any losses or damages resulting from unauthorized account use.
4. Subscriptions and Payments
4.1 Subscription Types
CloudDeck offers a variety of subscription plans, the specifics of which are provided on our website. These subscription options, including features and prices, may be updated from time to time.
4.2 Payment
By subscribing to CloudDeck, you agree to pay the specified subscription fee. Fees are charged in advance for the entire subscription period and are non-refundable. Payment must be made using any of the payment methods accepted by CloudDeck. It is your responsibility to provide valid and up-to-date payment information. If your payment fails for any reason, CloudDeck reserves the right to suspend your access to the Service until payment has been successfully processed.
4.3 Renewal
Subscriptions automatically renew at the end of each subscription period, ensuring uninterrupted access to the Service. You will be charged the then-current rate for your subscription plan. To avoid being charged for the next period, you must cancel your subscription before the renewal date.
4.4 Disputed Payments and Fraud
In the event that a payment is disputed, CloudDeck reserves the right to immediately terminate your service.
Upon identification of any fraudulent payment activity or chargeback, CloudDeck will initiate an investigation. If it is determined that the dispute was raised with fraudulent intent, CloudDeck reserves the right to pursue legal action against individuals involved in fraudulent activities.
5. Refund Policy
Payments made to CloudDeck are non-refundable, ensuring you understand and agree that once a payment is made, it is final and you will not be refunded for any reason.
6. EU Consumer Rights
For customers within the European Union (EU), by starting your subscription, you expressly agree to waive your right to withdraw from the contract as provided by EU consumer protection laws. This waiver does not affect your other statutory rights.
7. Usage of Service
7.1 Permitted Use
The Service is for your personal and non-commercial use only. You agree not to use the Service for any unlawful purposes or in a way that is prohibited by these Terms.
7.2 Restrictions
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service without express written permission from us.
7.3 Account Sharing
Exclusive Use: Your CloudDeck account is for your personal use only. Account sharing, which includes sharing your login credentials or allowing others to access or use your account, is strictly prohibited. Each account is intended for a single user and must not be shared with any other individual.
Security and Responsibility: You are responsible for maintaining the confidentiality of your account information, including your password. Any activities that occur under your account are your responsibility. Should you suspect any unauthorized use of your account or breach of security, you must inform CloudDeck immediately.
Consequences of Account Sharing: Engaging in account sharing may result in immediate suspension or termination of your CloudDeck service. CloudDeck reserves the right to take appropriate action against any users found to be in violation of this policy, including but not limited to the permanent termination of service. Account sharing undermines the security of your account, the integrity of our service, and violates the terms of this agreement.
7.4 Inactivity Policy
Automatic Console Turn-Off: To ensure efficient use of resources and fair access to our services for all users, CloudDeck employs an inactivity detection mechanism. If your account is detected as inactive for a specified period of time while using the Service, the virtual cloud gaming console will automatically turn off.
Prohibition of Tampering: Users are strictly prohibited from employing software, hardware, or any other means to interfere with, bypass, or otherwise tamper with CloudDeck’s inactivity detection mechanisms. This includes the use of programs or devices designed to keep the service active without direct user interaction.
Violation Consequences: Attempting to circumvent our inactivity detection by any means is considered a violation of these Terms of Service and may result in immediate suspension or termination of your account.
Encouragement of Fair Use: This policy is in place to promote fair use and optimal service availability for all CloudDeck users. We encourage users to log off or exit the service when not actively using it, allowing others to enjoy our cloud gaming offerings.
8. Code of Conduct
CloudDeck is committed to creating a respectful, safe, and enjoyable gaming environment for all of its users. To support this commitment, we have established the following Code of Conduct that all users are expected to adhere to when using our services. This Code of Conduct applies to all interactions within the CloudDeck service, including gaming sessions, online communications, and any use of the CloudDeck platform.

Do not publish, share, or promote content that is offensive, obscene, pornographic, or otherwise inappropriate. Content that promotes hate, violence, or discrimination is strictly prohibited.

9. Intellectual Property Rights
All content on CloudDeck, including but not limited to text, graphics, logos, and software, is owned by CloudDeck or its licensors and is protected by copyright and other intellectual property laws.
10. Termination
CloudDeck may terminate or suspend your account and access to the Service without notice if you violate these Terms.
11. Modifications to Terms
CloudDeck is committed to ensuring that our service evolves with the needs of our users and the dynamic landscape of cloud gaming. As such, we may update these Terms of Service from time to time to reflect changes in our service, legal requirements, or for other reasons.
